1. About this policy

Daconite provides AI-powered tools for creating advertising content for businesses. Daconite is offered to businesses and professionals acting in a professional capacity, and is not intended for consumers.

This Privacy Policy explains how we process personal data when you visit our website, apply for access, use Daconite, communicate with us, or provide content through the service.

Depending on the situation, Daconite may act either as a controller or a processor.

We act as a controller for information relating to our website, accounts, billing, support, security and business operations.

When a customer submits personal data within content for us to process as part of the Daconite service, we generally act as a processor on that customer's behalf. The customer remains responsible for determining whether that content may lawfully be used and for providing any required notices or obtaining any required permissions.

2. Information we process

Depending on how you use Daconite, we may process:

Where personal data about another person appears in Customer Content, we normally receive that information from the Daconite customer that submitted it.

Where permitted by applicable data-protection and marketing laws, we may obtain professional contact details from public company websites, professional networks, referrals, business partners or business-data providers to communicate with businesses about Daconite. You may object to this use or unsubscribe from marketing communications at any time.

When you apply for access, your answers are saved as you go, so an application you do not finish may still be stored. A copy of your answers is also stored in your browser so that you can continue later; it is removed after successful submission, when you choose “Clear application,” or after three months of inactivity. To protect the form from automated abuse, a security provider receives technical information such as your IP address. If you choose to book a call, the scheduling provider receives your email address and the booking details you enter. Where an application field is marked as required, we need that information to assess or respond to the application and may be unable to proceed without it.

3. How we use personal data

We process personal data where necessary to:

Depending on the processing involved, our legal bases include:

Where we process Customer Content solely on behalf of a customer, the customer determines the relevant legal basis and Daconite processes the data under that customer's instructions and applicable data-processing terms agreed with the customer.

We may use automated tools to help organise or review applications, but access decisions are not made solely by automated systems.

We do not sell personal data or share personal data for third-party advertising.

We do not use Customer Content to create advertising for other customers.

4. AI processing

Daconite does not use Customer Content to train general-purpose models owned or operated by Daconite, and we do not make one customer's Customer Content available to other customers. We use third-party AI providers to process content required to deliver the service. Customer Content, including images, may be sent to those providers as needed to generate the outputs you request. Their processing practices are governed by their applicable terms and our agreements with them.

5. Service providers

We use carefully selected service providers to operate Daconite.

These may include providers of:

Where a provider processes personal data on our behalf, we require it to process that data only for the agreed purposes and subject to appropriate contractual and data-protection obligations. Certain professional advisers and other recipients may process personal data as independent controllers where required for their professional or legal responsibilities.

Where Daconite acts as a processor, information about subprocessors is provided to customers in connection with applicable data-processing terms agreed with the customer or on request.

We may also disclose personal data where required by law, to protect our legal rights or the security of the service, or in connection with a corporate transaction such as a merger, acquisition or sale of assets.

6. International transfers

Some of our service providers may process information outside Spain or the European Economic Area.

Where required, we put in place legally recognised transfer mechanisms, such as adequacy decisions, Standard Contractual Clauses or other lawful mechanisms, with relevant providers. Where these arrangements are not yet complete for a provider, we are working to put them in place.

You may contact support@daconite.com for more information about the safeguards applicable to your personal data.

7. How long we keep data

We keep personal data only for as long as reasonably necessary for the purpose for which it was collected and to meet our legal obligations.

In general:

When an account is closed or deletion is requested, we delete Customer Content from our active systems as part of our deletion process. Residual copies may remain temporarily in backups or service-provider systems until normal deletion cycles complete.

8. Cookies, local storage and analytics

Daconite may use storage that is strictly necessary to provide the service, including keeping users signed in and preserving work in progress.

Our public website uses EU-hosted, cookieless analytics to measure page visits, interaction events and website performance. The analytics do not store cookies or analytics identifiers on your device, create session recordings or replays, or create individual user profiles. The analytics provider receives an IP address when processing a request, but our configuration is set to discard the raw IP rather than store it. We may receive approximate country, region or city information derived from the request, but not a visitor's precise location.

We do not use advertising cookies or cross-site advertising trackers.

If we introduce technology for which consent is legally required, we will request consent before using it.

9. Your rights

Where Daconite acts as the controller of your personal data, you may have the right to:

You can exercise your rights by contacting support@daconite.com.

We will respond in accordance with applicable data-protection law.

If the personal data concerns content submitted by a Daconite customer and we are acting as that customer's processor, the customer is normally responsible for handling your request. If you contact us, we will assist the relevant customer where required.

You also have the right to lodge a complaint with the Agencia Española de Protección de Datos (AEPD) or, where applicable, your local data-protection authority.

10. Security

We use appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, misuse, alteration or disclosure.

No online service can guarantee absolute security.

11. Children

Daconite is a business service and is not intended for people under 18.

You must not upload or generate advertising content featuring identifiable minors.

12. Changes to this policy

We may update this Privacy Policy as Daconite develops or where legal requirements change.

When we make material changes, we will update the date at the top of this page and provide additional notice where required.
